These Terms and Conditions govern the use of the services and website (“Service” or “Services”) that are made available by Vancouver Island Naturopathic Clinic Inc. (“Vancouver Island Naturopathic Clinic Inc.”, “VINC” “we” or “us”). These terms and conditions represent the whole agreement and understanding between Vancouver Island Naturopathic Clinic Inc. and the individual or entity who subscribes to our service or website (“Member(s)”, “Patients", “Clients” or “you”). Vancouver Island Naturopathic Clinic Inc. may in its sole discretion, change or modify this agreement at any time with or without notice. All modifications shall be made effective for all members upon posting of the modified agreement to this website or services. You are responsible to read this document from time to time to ensure that your use of the service remains in compliance with this agreement.
You agree to indemnify, defend and hold us and our suppliers harmless from and against all claims, damages and expenses arising out of or related to your use of this site, except to the extent permitted by applicable law.

The content, products and services offered herein are only for educational purposes and do not substitute the need for medical advice, diagnosis or treatment. If such Services are offered by us, we will provide you with any terms and conditions related to the Services prior to your enrollment in the Service. The terms and conditions of such Services shall prevail in the event of a conflict with these Terms. We do not endorse any Services offered by third parties. We make no warranty of any kind as to the accuracy, completeness or appropriateness of any such Services.
These terms are governed by the laws of the Province of British Columbia. You consent to the exclusive jurisdiction and venue of courts in British Columbia in all disputes arising out of or relating to the use of this site. Any cause of action or claim you may have with respect to Vancouver Island Naturopathic Clinc Inc. or its suppliers must be commenced within two (2) years after the claim or cause of action arises. Neither our nor your failure to enforce strict performance of any provision of these Terms shall be construed as a waiver of any provision or right. We may assign our rights and duties to any party at any time without notice to you, and may provide services to you through our business partners and suppliers.
Our performance of these Terms is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of our obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of this site or information provided to or gathered by us with respect to such use. If any part of these Terms is determined to be invalid or unenforceable then the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these terms shall continue in effect. You hereby irrevocably submit to the exclusive jurisdiction of the Courts of the Province of British Columbia for any dispute arising under or relating to this agreement and waive your right to institute legal proceedings in any other jurisdiction. We shall be entitled to institute legal proceedings in connection with any matter arising under this agreement in any jurisdiction where you reside, do business or have assets.
No Warranties; Limitation of Liability
You are responsible for any acts or omissions relating to your use of this website and for any damages incurred as a result thereof. YOU ACKNOWLEDGE AND AGREE THAT WE HAVE NOT REPRESENTED this site AS HAVING THE ABILITY TO DIAGNOSE DISEASE, PRESCRIBE TREATMENT, OR PERFORM ANY OTHER TASKS THAT CONSTITUTE THE PRACTICE OF MEDICINE OR OF OTHER PROFESSIONAL OR ACADEMIC DISCIPLINES. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISLAIM ON BEHALF OF US AND OUR SUPPLIERS, ALL RESPONSIBILITY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, AND PUNITIVE DAMAGES, AND LOST PROFITS, REVENUES OR DATA. IF YOU ARE DISSATISFIED WITH this site, OR WITH THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING this site.
We reserve the right to delete, modify or add any element, documentation, picture, or content within our website. It is themembers’ sole responsibility to confirm the information is up to date and accurate as any notification obligation is not required on our behalf.
Vancouver Island Naturopathic Clinic Inc. owns all intellectual property rights relating to the website content including pictures, forms and information on this website. Any reproduction of anything on our website must be requested and approved in writing prior to use or it is forbidden. If approval is not given reproduction is prohibited and use of material or graphics should cease immediately or we may take legal action.
Clinic Product Return Policy
We do not guarantee product results or success from products purchased through our clinic. Natural herbs and supplements, just like medicines, can have side effects. We cannot anticipate all adverse reactions or side effects as they are individual and unique per each person. We are not able to offer a refund once the seal of a product is broken and/or the bottle is opened. We will offer a full refund if a bottle is returned to us unopened, seal intact and in excellent condition with-in 14 days of date on receipt of purchase. Supplements returned after 14 days and with-in 30 days of original purchase date unopened, seal intact and in excellent condition will receive an in clinic credit towards your next purchase or treatment. We do not accept products for return if returned 30 days or more from the original purchase date on the receipt. We do not offer refunds for any compounded botanical tinctures.
